1. Who you are contracting with

Fucini Software is the name under which Fucini Consulting, Reg. No. 46062728, 04053 Kyiv, Nestorivskyi Lane, Building 10, Office 2/1, Ukraine (“we”, “us”), publishes its software. It is not a separate company: whatever you buy or use here, Fucini Consulting is the party you are dealing with.

2. Purchases

Purchases are sold by Paddle.com Market Limited as merchant of record. Paddle is the seller for the transaction, issues your invoice, and handles tax. Their buyer terms apply to the purchase itself. What a purchase entitles you to — seats, devices, renewal, what a plan includes — is set by the terms of the product you bought.

3. The products, and their own terms

Fucini Coverage Studio is for sale. Its use is governed by its own Terms of Service, which cover plans, seats and devices, the licence you get, trials, billing and cancellation.

The products on the road ahead are announced, not released:

Nothing about them is for sale. Their pages are information only: what they will include, what they will cost and when they ship may all change, and no statement on those pages is a promise to deliver. Each gets terms of its own when it is released, and this page will lead to them.

4. Your account on this site

If you buy a subscription, or are invited to a seat in a team’s pool, an account is created for you here so you can reach your downloads, your licence codes and your seats. Keep your credentials to yourself: you are responsible for what is done through your account, and the site will ask you to set up two-factor authentication to protect it.

An account exists to deliver what was bought. We may close one that is used to defeat a product’s licensing, to reach material it is not entitled to, or to interfere with the site, and will contact you first wherever we reasonably can.

5. Refunds

Fourteen days from any payment, no reason required — the full terms are on the refund policy page. If you are a consumer in the EU or UK you also have your statutory withdrawal rights, which that policy does not reduce.

6. Your data

How we handle your data is set out in the privacy policy. In short: your source code stays on your machine, telemetry is off unless you enable it, and we never see your card.

7. Warranties and liability

We work hard to make our software correct and useful, but it is provided “as is”. Where a product derives figures from data your own tools produce, they are an aid to judgement, not a certification, and you remain responsible for deciding whether your software is fit to ship.

To the extent the law allows, we exclude implied warranties, and our total liability to you for any claim is limited to what you paid us in the twelve months before it arose. We are not liable for lost profits, lost data, or indirect or consequential loss.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

8. Changes to these terms

We may update these terms. The date at the top changes, and if a change matters to you we will tell you directly before it takes effect for your subscription. Continuing to use the site or the software after that means you accept it.

9. Law and disputes

These terms are governed by the laws of Ukraine, and the courts of Ukraine have jurisdiction. If you are a consumer resident in the EU or UK, this does not deprive you of the protection of the mandatory law of your own country, or of your right to bring proceedings there.
